Niners Forfeit a 5th & Swap 3rds in Tampering Case

According to Yahoo Sports, the San Francisco 49ers have forfeited their fifth-round pick in next month’s NFL draft after commissioner Roger Goodell deemed them guilty of tampering with Chicago linebacker Lance Briggs.

Goodell also determined the teams will switch picks in the third round of the April 26-27 draft. Chicago, which had the 12th pick, will get San Francisco’s seventh pick and the 49ers will get Chicago’s choice.

Goodell determined that the 49ers violated the NFL’s anti-tampering policy by contacting Briggs’ agent, Drew Rosenhaus, about his client during the 2007 season.

“The 49ers organization respects Commissioner Goodell’s ruling today, however we do disagree with it,” said 49ers General Manager Scot McCloughan. “This was not a malicious act; we believe that our intent was within the NFL guidelines. Going forward, we will take the necessary steps to ensure we are in compliance with the NFL’s interpretation.”

Now what I would like to know is what do the Dolphins lose for tampering with Justin Smiley considering he was signed five minutes after the start of free agency.

    2000 - Paul Smith, John Milem
    2001 - Forfeited
    2002 - Brandon Doman, Josh Shaw
    2003 - Aaron Walker
    2004 - Traded to Bears
    2005 - Ronald Fields
    2006 - Parys Haralson
    2007 - Tarell Brown

    So losing the pick doesn’t really hurt a whole lot.

    This is bullshit though.. the swap in the 3rd doesn’t do much for us drops us back 5 spots. but still a bitch b/c guy we want could now go in those 5 spots. I thought giving up the 5th rounder was enough. Thought the swap was a little to much. With us losing a pick though. Look for us to maybe pull a trade with someone to recoup a pick. by either trading back or trading a player or a late pick next year or something.
    And mark everyone cares about draft picks.. WHY B/C half our team is built on them.

  16. Yeah, I agree, we lose the 5th only and I am thinking, “Ok, this sucks, but it is better than losing a 4th like McNolan was originally fearing.” Now it is just insult to injury. COUNT ON the niners to draft two o linemen with their first four picks. Before they could go with the best player available….now, it is different. I am not saying a 5th would make or break us, but it would help us FOR SURE!!!! I expect our 5th rounder from the last draft to be a starter by the end of this season (provided we don’t draft a cb in the first day). This isn’t cool. I expect the niners to either go offense, offense with our first two picks or offense, defense. We still might go defense then offense with our first two picks, but it wouldn’t be smart given our o line situation. The o line is the one spot that is DYING for more players. We could use a TBC replacement, but not if Otah or Cherilius is still available. That will put the heat on Mr. Glass OR the niners will put him at center like he should be right now.

    Can’t have pats swap picks back. Same reason to where if they wanted to punish us harder they couldn’t have gone after this years first round pick. They aren’t teams original draft picks. They were acquired via trade and If NFL looks to penalize they would go off of teams ACTUAL PICKS. Now while we do have the 29 that is OUR PICK it was recieved via trade and nfl couldn’t take it away. Just same reason why pats didn’t lose the 7 instead of the 31.

    I do agree that shouldn’t have swapped picks though. That was ridiculous since they still got there man.

  30. while a 5th rounder isn’t a huge deal, every draft pick counts. I think Godell is just trying to save face after being criticized (rightly so) for going easy on the Pats. Kind of like how refs sometimes make a questionable call on one team in a game, then a few plays later make a questionable call on the other team. Come on, that happens all the time, you all know what I mean. But, in a way I agree that we should go after the Dolphins to call out Godell. But, do we really want to open up this can of worms even further? After all, I’m sure we didn’t do anything that hasn’t already been done a hundred times by just about every team. So, I almost feel like we would be sinking to the Bears’ level. But, don’t we deserve to get that pick back? And, maybe it would prove that we aren’t the only ones doing this stuff…

  41. I have the perfect fix for this situation. The Bears lost Muhammid and Berrian to free agency. The only receiver they have left is Rasheid Davis who in my opinion is a really good receiver and is also a restricted free agent. I respect Matt and how he covers the niners like white on rice, but we should not COMPROMISE a quality pick in the name of getting a 5th rounder back.   46. If the 49ers have a chance to get pass-rushing outside linebacker Quentin Groves of Auburn with the No. 29 overall pick, they might be wise to take him. Otherwise, they could look to bail out of the first-round slot in the draft.

    If the Falcons are looking to move up, the 49ers could trade pick No. 29 to the Falcons to move back to No. 37 overall. Using the draft-pick trade chart, the 49ers would be owed 110 points.

I agree with you Adam although everyone want Groves, I think the smart thing would be a WR or a Lineman at least I say Jackson or Sweed if he not there trade with Atlanta, and get a WR with Atlanta second round pick whoever is avaliable (theres enough talent so a WRs got to be there). Sam Baker is still projected to be at our second so get him, if not get another lime man but Im sure he’ll be there.

    perfect for what we need. We trade the 29th, (our 1st}, 75th (our 3rd), and 103 (our 4th). For Atlanta’s 37th, (2nd round) and the 48
    (2nd round). with our 39th (2nd). We can get 3 starters still. OL, WR, pass rush, Most NFL people, (Not media types) think that the
    strength of this draft is the 2nd round…. We don’t need more 6th
    and 7th round selections. Since Nolan took over, our 3rd and later round picks haven’t helped much. The 29th isn’t a 1st round quality
    pick this year. Baker 37th, Andre Caldwell 39th, Laws 48th, 3 starters………..

  52. Yeah, I get WHY he is saying it. However, it STILL doesn’t mean we should do it. With drafting Baker we have ONE potential starter. IF we get Caldwell HE WILL NOT START (furthermore, he will be last on the depth chart) and Laws WILL NOT be there at pick 48. IF we do something like this, in my opinion, we are trading two possible starters (our first and second pick) for ONE possible starter and some more depth. I am tired of building up depth….after what I saw last season we need PLAYERS not depth. If we stay put we can get Groves (maybe), Cherilius (WOULD start a right tackle), or maybe a decent receiver like Hardy. These guys have a potential to GET ON the field instead of holding a clip board. The more clip board holders we draft the more likely we will go 6-10 next year. We need difference makers.

For what its worth, I personally would like to get Groves wit our 1st over Hardy or any other WR…….Reason, with Martz we will take chances (which isn’t a bad thing, cant wait}…an score fast I believe……I feel we need a strong pass rush to keep our opponents offence off da field an give us more chances to run up the score….Tully isn’t da answer….He’s a better backup for us…..Just don’t want to go score for score with our opponents

  57. Hardy will fall to the second round. Mark my words. I don’t know if he will make it to us, but he will be a second round pick at WR. There are 6 or 7 WRs considered better than him. Trust me 6 or 7 WRs won’t be drafted in the 1st round. Maybe 3 or 4. Hardy will be a second round pick, mostly because of his off the field incident in 2006, that he has completley changed from now, but the risk is still there.

    In checking with the 49ers, all of the players who were injured last season are participating in the team’s offseason conditioning program.

    That goes for everyone, including cornerback Tarell Brown, who sustained partial tears of the ACL and MCL in his right knee in the season-finale against the Browns. The injury did not require surgery, and Brown is back running around.

    The same goes for Joe Cohen, Jay Moore, Melvin Oliver, C.J. Brewer, Manny Lawson, Alex Smith and Shaun Hill.

  61. I am with you ninersgold, take Hardy with the second pick and smile while they do it. Groves or Cherilius work for me in the first. I just don’t think that Groves will be available. I think if he isn’t selected at 25 then he could fall to us. I don’t think the Bolts or the cowgirls would want him since they Merriman and Ware. I don’t think he is a priority. However, I think it would be more interesting if we drafted Cherilius because that would put MAJOR pressure on Mr. Glass (what I have wanted all along) to start. I KNOW Staley will start at left tackle, but at right tackle if the battle is between Cherilius and Mr. Glass I guarantee you that Nolan goes with Cherilius because he doesn’t suffer from vaginitis. IF Cherilius starts then that means he starts at center or becomes a back up. We need ONE quality tackle and ONE quality interior lineman that can play guard AND center.

    McKAY: I can say from the Competition Committee standpoint we didn’t know anything about the 49ers’ situation, any of the facts or any of the discussions when we discussed the integrity of the game memorandum that the Commissioner submitted to us.

    ANDERSON: Likewise here. That had no effect in our discussion at the meetings in Naples.

    Q: Would a situation like the 49ers’ tampering conviction be something that would fall under this policing category?

    ANDERSON: Yes, particularly with regard the duty to report and ultimately the duty by senior folks to certify that they have not violated our rules and policies. So these measures that we’re talking about would, in fact, cover a situation like that.

  69. Ok lets just forget this idea about mcnabb already. We exercised option with Smith to extend his deal. He’s staying.
    There are actually rumors though that Packers may look to take a QB in round 1 if say Brohm were to slip to them. Since Rodgers has sat on the bench for so long they are not sure if he is there guy plus he has had a problem with staying healthy and thats kinda sad since he really hasn’t played more then like 15-20 snaps in 3 years. If thats the case could see teams like Dolphins, Falcons(if they pass up on Ryan), Ravens, Bears, and Panthers looking to jump up to our spot or the cowboys spot in front of us. That would make for Ideal situation if the guy we are eyeing isnt there with our pick anymore.. I mean trade down with Phin’s and drop what 3 spots figure pick up an extra 4th.
    Falcons could pass on Ryan I read a few places that they may look to take a Dorsey or Long if they fall. There new GM was from pats Org. and philosophy he learned was to build the lines then build out. So could see them take a lineman and then trade up for a brohm, or draft a henne,whose stock is climbing like crazy, or a flacco in the 2nd.

    2006, the line wasn’t the problem, the play calling wasn’t the problem. Smith could only complete a pass when he rolled out. He gets happy feet and becomes ineffective. The saddest part is he might win the QB competion and will have another 5-9 or 6-10 season.
    We need to upgrade our QB wether or not we picked up the option. You
    can’t trade a QB if you don’t act like he is a talent. If we didn’t
    pick up the option, the we would never be able to unload him…

  72. People don’t usually trade for former number high overall picks if they are QBs. If they don’t work out with their initial team they hang around the league as a back-up, David Carr, or they just go away, Akili Smith. Smith gets paid way too much money to be traded. We had to renew his option because the way his contract was set up he would’ve been paid the money anyway, he just wouldn’t have to do anything for it. I personally have a feeling that Smith will be better this year, not Peyton Manning, but better. If we sure up our offensive line and get Gore back on track I think he could make some noise this year.

Nolan has to realize that if his team keeps going up and down at the same time with having a new O coordinator that owners are going to say, “Hmmmm, he is a good coach on defense and knows how to motivate people, but he NEEDS someone to run his offense because he doesn’t know how!” He is VERY conservative and the NINERS HISTORICALLY DON’T PLAY RAVEN BALL!     then we’ve lost another year. We have to take advaantage of Martz
    ability to nurture and coach up QB’s. You can bet if we take a QB
    in this draft, then Martz sees the possibility of a leader. At the

    Next years draft is gonna be void of top QB prospects. You can bet

    players cut June 1st. A 3rd or 4th rounder isn’t gonna be a starter
    this year anyway. So why not a QB??????? If we draft a WR in the 3rd

  89. Jerry, I just don’t understand, you say that you don’t want us to rebuild every couple of years but we have to cut ties with everyone who isn’t a pro bowler and draft replacements. That is called rebuilding. Personally I didn’t want Smith when we drafted him, I thought Braylon Edwards was the talent of the draft and thought that we should’ve taken him, but now that we have him you have to give the kid a shot. People were all over Michael Vick’s nuts because he produced high light reals, but he really did suck. After teams stopped his scrambling, he was very beatable. It wasn’t that he was a bad quarterback it was because he wasn’t pro ready. Neither is Alex, he came from a system that does not translate to the NFL. The same thing will happen to Tebow. He needs time to adjust, and he was playing decent before he got hurt last year, he kept in the Steelers game and we probably could have one it if Lelie ran the right route at the end of the game.

    Also, you say we should trade Alex now before everybody figures out he sucks? People aren’t even sure if his arm is going to heal properly. There is 3 years of footage to prove that he isn’t the greatest. We aren’t going to trade Smith, it is not going to happen, even if we wanted to, it wouldn’t happen. Its not an issue of what we’d get back for him, it is an issue of who would take him.   93. Ok 2nd half of your draft aint there.. I’ll start from 7th and work my way up. Dixon maybe there in 7th but someone may take chance on him in 6th hoping that they get a steal. Dejuan Morgan is considered the 2-3 best safety in the draft. He’s gone by 3rd round at the latest.
    6th round Franklin does not fall that far. Is gone somewhere in 4th more then likely same thing with dexter jackson. Although Jackson could jump to 3rd our fall to the 5th. He won’t fall to 6th though. Why b/c he also has return man ability. Now 4th I’ll give you as Johnson, ainge could be there. However a QB in the 4th is NOT A NEED. Sorry but we have more issues then a QB that early on. And Royal b/c of that return ability has jumped into the 3rd. That combined with fact he had a great senior bowl. ok 3rd round Caldwell I think goes somewhere in the 2nd. Hill and Rubin should be there. 2nd round. Cherillus does not make it to us in the 2nd hell he may not make it to us in the 1st. Also don’t think Balmer a 3-4 de is a 2nd round need. We just signed Justin Smith theres one end. And Sopoaga takes the other end spot where I think he is better suited. We need NT not DE. Laws could be there but again I think he would be better off at DE spot he likes to penitrate not take on blockers. He was the only bright spot for ND this past year though.
    First round I love albert and would love for him to fall to us however I don’t think he makes it pass the steelers who need to replace faneca at guard. I like both groves and cherillus just think tackle is a Bigger need so I’d go that way. However thats me.

We all are giving the kid one last chance with martz to show what hes got. I think this offense is best suited for him. I think Martz system is perfect for Smith. Thats my opinion though.

Stop jumping to conclusions about how you think its going to work out with smith starting.No one knows.     Have to have faith that with new oc in who actually knows how to run an offense. Things have a high chance of turning around.     Fields as starting UT and McDonald as starting DE. Of course they
    still have to adjust for Smith at UT. Nolan said 2 weeks ago on the
    Razor and Mr T show. That McDonald was the DE going into the mini-
    camps. I realize that they will be rotating. Because Groves won’t
    last. We can’t count on TBC for our pass rush. Were gonna have to
    get it from a DE in 4-3 on passing downs. Balmer, Calais Campbell.
    One of them could be there at 39. Where do you get your info on the
    2 safeties? NFL Draft Dog.com Value Board has both ranked in the 6th
    round which means 1 or both could drop to the top of the 7th.

    I just can’t see us paying Soapoga all that money to be a backup. If thats what he is then we should have just let him go rather then pay him as much as we did. B/c for a backup we could have just drafted a rookie and payed him 1/4 of what we are paying soapoga.
    I agree we can’t look to TBC as our pass rush. He is a backup and thats what he should always be. He is not anything more then a backup. Balmer could go in the first round which is very likely however. If you want an end i’d rather go with laws then. I think he has better pass rush ability that could command that double team. Not b/c he’s taking on blockers but b/c he can get through the line and that will force teams to double him or atleast bring over that rb for extra blocking

  101. MSouza I don’t think that a mid or late round draft pick is gonna be
    ready next year. It will take time 2 to 3 years. What I’m saying is
    we need to have someone in the wings learning from Martz, while we
    have Martz on our staff. If we don’t draft someone I would like to
    think that it is because Martz didn’t think that the young QB’s
    weren’t adequate. Not because they don’t want to hurt Alex’s feelings. If he wins the job so be it. If he continues to struggle.
    Which I think he will, then it would be nice to have another QB learning the system from Martz. There is a reason why Hill and
    O’Sullivan have been in the league for 6 years or so, and not made
    there mark. They have limited ability. Good for emergency use only.
    Nobody wants the Niners to win more than me. i’m looking at the
    franchise for years to come. Not just the 2008 season.

  102. O’sullivan was a sixth round pick. You said it yourself he’s been in the league for six years or so and hasn’t made any noise. We could use every pick this year on a quarterback and they could all suck, all I’m saying is that give this QB core a chance. I want the franchise to win in the future too, but I think that the best chance is with Smith or Hill, hell if O’Sullivan wins the job then so be it. I’m just tired of this rebuilding process and thats all we are ever going to do if we expect every player to pan out before their fifth season. There is a reason you can’t judge a draft class for five years, it takes that long to find out what you got.

    us this year. I’m talking about drafting a future QB (FOR IN THE
    FUTURE)…….I never said blow up the team. And or draft every QB
    available. If Martz feels that there is a QB in this draft, that
    could be better then the 4 we got. Then draft him and start giving
    him reps in practice so that he’ll be ready in 2 or 3 years. If Alex
    is the starter for the next few years so be it.

    The whole point is to take advantage of Mike Martz ability to groom
    Quarterbacks. If Alex steps up and keeps winning the job great. But
    i’m tired of a sub 500 team. Management keeps saying there gonna
    get better players to compete. I think it should be at every position including the QB. Which it hasn’t been since Alex got drafted. Martz if successful won’t be here very long. he’ll be offered another head coaching job.

    What makes Alex Smith any different than any other draft pick. San
    Diego had Drew Brees and went ahead and drafted P Rivers. Rivers
    in his 2nd year beat out Brees and they let him go as a free agent.

    Where did you get 5 years……..They become free agents in 3 or 4
    and there usually gone. The only place they get 5 years is when the
    Yorks are signing the checks.

    Hopefully are team will improve after this draft and our management
    will truly draft the best available..And quit worring about hurting
    Alex feelings. Its time to put up or shut up for Alex.

    I think it was 1979 when Steve DeBerg was our starting QB he was
    an under 500 QB. But he had all the tangables, (he was much better
    than Alex). When Walsh drafted Montana in the 3rd round all the
    media said why would you waste a 3rd round pick on a QB, you got
    DeBerg. 2 years later Montana won the starting job. And Walsh when
    asked why Montana was going to be the starter, he said DeBerg was
    just good enough to lose.
