Niners Forfeit a 5th & Swap 3rds in Tampering Case

According to Yahoo Sports, the San Francisco 49ers have forfeited their fifth-round pick in next month’s NFL draft after commissioner Roger Goodell deemed them guilty of tampering with Chicago linebacker Lance Briggs.

Goodell also determined the teams will switch picks in the third round of the April 26-27 draft. Chicago, which had the 12th pick, will get San Francisco’s seventh pick and the 49ers will get Chicago’s choice.

Goodell determined that the 49ers violated the NFL’s anti-tampering policy by contacting Briggs’ agent, Drew Rosenhaus, about his client during the 2007 season.

“The 49ers organization respects Commissioner Goodell’s ruling today, however we do disagree with it,” said 49ers General Manager Scot McCloughan. “This was not a malicious act; we believe that our intent was within the NFL guidelines. Going forward, we will take the necessary steps to ensure we are in compliance with the NFL’s interpretation.”

Now what I would like to know is what do the Dolphins lose for tampering with Justin Smiley considering he was signed five minutes after the start of free agency.

  1. Los Banos Jerry says:

MSouza I don’t think that a mid or late round draft pick is gonna be
ready next year. It will take time 2 to 3 years. What I’m saying is
we need to have someone in the wings learning from Martz, while we
have Martz on our staff. If we don’t draft someone I would like to
think that it is because Martz didn’t think that the young QB’s
weren’t adequate. Not because they don’t want to hurt Alex’s feelings. If he wins the job so be it. If he continues to struggle.
Which I think he will, then it would be nice to have another QB learning the system from Martz. There is a reason why Hill and
O’Sullivan have been in the league for 6 years or so, and not made
there mark. They have limited ability. Good for emergency use only.
Nobody wants the Niners to win more than me. i’m looking at the
franchise for years to come. Not just the 2008 season.

  2. MSouza says:

O’sullivan was a sixth round pick. You said it yourself he’s been in the league for six years or so and hasn’t made any noise. We could use every pick this year on a quarterback and they could all suck, all I’m saying is that give this QB core a chance. I want the franchise to win in the future too, but I think that the best chance is with Smith or Hill, hell if O’Sullivan wins the job then so be it. I’m just tired of this rebuilding process and thats all we are ever going to do if we expect every player to pan out before their fifth season. There is a reason you can’t judge a draft class for five years, it takes that long to find out what you got.

  3. Los Banos Jerry says:

when did it become 5 years it use to be 3 years. Every coach had a 3 year plan. Your 1/2 right one of these 3 guys are gonna start for
us this year. I’m talking about drafting a future QB (FOR IN THE
FUTURE)…….I never said blow up the team. And or draft every QB
available. If Martz feels that there is a QB in this draft, that
could be better then the 4 we got. Then draft him and start giving
him reps in practice so that he’ll be ready in 2 or 3 years. If Alex
is the starter for the next few years so be it.

The whole point is to take advantage of Mike Martz ability to groom
Quarterbacks. If Alex steps up and keeps winning the job great. But
i’m tired of a sub 500 team. Management keeps saying there gonna
get better players to compete. I think it should be at every position including the QB. Which it hasn’t been since Alex got drafted. Martz if successful won’t be here very long. he’ll be offered another head coaching job.

What makes Alex Smith any different than any other draft pick. San
Diego had Drew Brees and went ahead and drafted P Rivers. Rivers
in his 2nd year beat out Brees and they let him go as a free agent.

Where did you get 5 years……..They become free agents in 3 or 4
and there usually gone. The only place they get 5 years is when the
    Yorks are signing the checks.

Hopefully are team will improve after this draft and our management
will truly draft the best available..And quit worring about hurting
Alex feelings. Its time to put up or shut up for Alex.

I think it was 1979 when Steve DeBerg was our starting QB he was
an under 500 QB. But he had all the tangables, (he was much better
than Alex). When Walsh drafted Montana in the 3rd round all the
media said why would you waste a 3rd round pick on a QB, you got
DeBerg. 2 years later Montana won the starting job. And Walsh when
asked why Montana was going to be the starter, he said DeBerg was
    just good enough to lose.

We shouldn’t be happy with mediacrity. Its time for CHANGE translation PLAYOFFS………………..

  4. Adam says:

Hey Jerry, well id be pissed if Bush ended the war,we need to stay and kill every terrorist we see,and he already did fix the economy when he got into office. It was jerk off Clinton who let the economy goto hell.Plus a President can do very little to an economy,it goes up and down thats what it does. And back to football, ya we went 7-9, WITH THE LEAGUE’S WORST DEFENSE. So Alex must have done a little right. And he did great with what he had.Gore and thats it.You say the only game Smith did good in was the ones he scrambled in, well he scambled a whole buch that year if you remember.Look all im saying is I dont think ANYBODY can put the blame soley on Smith, and that’s what alot of people are trying to do.AND I’M SPENT.Buy the way im a huge Goerge Bush fan.

  5. hondakillerzx says:

BUSH IS A FUCKING IDIOT!!! you must be a blind republican if you think he helped this country at all. but thats a different subject. they have 2 QB’s, we’ll see if these guys can cut it. i think they will hold off on drafting a QB this year.

  6. Adam says:

I am a Republican you fuck and i know he’s helped this country. That is why he got elected twice. You fckn moron.Bush is the man.Too bad he cant run for a third term. I can tell ur a commy Democrat pussy. We have 1 QB and it’s Alex Smith.Don’t beleive this is a open QB competition. That’s a bunch of BS.We would not have picked up the option if he wasn’t gonna be the starter.I’m willing to bet the farm that come September #11 will be out starting QB.And I beleive he will be the starter for years to come.Thank God for the GOP

  7. Ryan the 1st says:

Amen, God bless the GOP…..Adam I knew I liked you. As a fellow Republican I am glad to shake your hand.

  8. MSouza says:

Actually Jerry, most first day picks get 5 years and if they are any good they renegotiate in year three or four. It is only second day players that get 2-4 year deals. Nobody gets 30 mil guaranteed for 4 years. Smith got a six year deal with team option on sixth season. You can judge a class after three years, but if you had you would say that the Giants class four years ago was a bust. Usually most analyst give it five years to give definitive answers, but your right people still judge at three seasons. Also, the Phillip Rivers thing was because of the war going on between Shottenhiemer and Smith. Brees was not beat out, he was injured and got cut because AJ Smith was looking for a reason to get Shottenhiemer out. I would agree with you that drafting a late round QB and let Martz groom him for a few years and unleash the new Romo, but like you said if Martz has any success he’s going, but I do understand what you are saying. I just don’t think any of the late tier QBs this year will amount to anything, accept maybe Flacco but he’s likely going earlier than the fourth.

    please don’t talk politics.

  9. red&goldforlife says:

cmon, politics!! I agree! Question: who would you rather have as our starter on our team (Hypothetically) aaron rogers or alex smith? If the packers had Alex Smith on there roster who would they start aaron rodgers or alex smith?

  10. red&goldforlife says:

I think most teams if faced with this scenario would start aaron rogers. Even though alex was picked first and aaron has only played less than even shaun hill, I just feel most teams would pick aaron. who do you think Martz would start?

  11. niner says:

rogers is way better than smith. aaron is from my hometown so i grew up watchin him, he has all the tools to be a great qb, plus he was under farves wing for three years so he knows what he is doing

  12. ninersgold says:

yeah niner that is why if he was with us he would be worse than Smith.

He actyually has his flaws as well, but under Favre they have gone away, so lucky for him he was under Favre for three years or we would see how he really was. Even the GB team didn’t like him when they originally drafted him in practice because he was doing horrible. He had trouble throwing the ball accuratley. To be honest Smith definitley was a better pick at the time. If we could do it now after he has been under Favre hell yeah get him, but he wasn’t that great coming out of College.

  13. ninerfaithful says:

rogers better than smith ? you could question it yes, however i think that is something that can be awnsered during the season since this is arron’s first full season under center >>> but if asked now if i think Aaron is better than alex??? no way in hell >>>

  14. niner says:

ninersgold thats what i meant, bcuz aaron did have farve & he has been learning from farve for three years that i do think he is better now, however coming out of college i would want smith which is what we did. but shit if it were up to me i would of picked braylon edwards the wr on the browns. but thats just me…

  15. the niner man says:

niner faithful i agree with you how can you compare a qb that has never started a season

  16. ninerfaithful says:

niner man i am not saying that Aaron wont be good but i think this could become a legitament topic after we see him under center this season

  17. red&goldforlife says:

ninerfaithful, (Hypothetically)do you think since macarthy was Alex’s OC in SF he would start alex over Aaron rogers this year?

  18. red&goldforlife says:

I heard favre dissed rogers that he didnt take him under his wing!

  19. Adam says:

Give Alex Smith Greg Jennings,Donald Driver,Koren Robinson and the Packers offensive line then give me a Aaron Rodgers Alex Smith comparison.Alex did what he could with what he had.I mean come on the dude was like 12 when he started in the NFL(a little exageration but you get my point).I ask you as Niner fans to take a deep breath and watch Alex with some tools under his belt.I see great things from this guy.Im rollin with Alex and Ryan the 1st.

  20. West says:

Lito Sheppard maybe on trade block….wouldn’t mind 9erz making a move on him….

  21. Medford says:

Oh god who the hell told Adam to come back on here? Instead of going off about how great Derek Smith is. Now he wants bush to get a 3rd term. What have u been smoking dude u must be on something to say that go outside and look at gas prices how many innocent kids r getting killed for no reason?

Ryan I respect u on here I just dont agree with u I have kids and I want them to have a long life and if McCain gets elected we will probably be in Nuclear war then we wont have to worry about 49ers sports or anything im not saying democrates r great but they r a whole lot better than a senior citizen running the white house!!!!

Hey Adam Derek Smith probably has a Chargers jersey out now #50 it matchs his 40 time at the combine!!

  22. NINER81 says:

ALEX SMITH HAS NO EXCUSES NOW. HE KAS GOOD TALENT AROUND HIM. BETTER THAN GOOD. I THINK RODGERS IS BETTER. I HAVE SEEN THROWS THAT HE MAKES THAT I HAVE YET TO SEE FROM SMITH. I HAVE SEEN HILL MAKE THOSE KIND OF PASSES.THE BEST PASS I,VE SEEN FROM ALEX WAS A PASS OVER THE MIDDLE AGAINST DEVER IN LAST YEARS PRE- SEASON GAME.MARTZ SYSTEM REQUIRES THE QB TO MAKE QUICK READS AND BE ACCURATE. THERE IS NOT A LOT OF ROLL OUT PLAYS. YOU NEED TO STAY IN THE POCKET AND DELIVER THE BALL ON TIME AND UNDER FIRE. WITH THE SPEED WE HAVE AT WR, THE DEEP BALL HAS TO BE APART OF OUR ATTACK. ALEX HAS NOT SHOWN THUS FAR THAT HE HAS THE ABILITY TO SUCCESSFULLY RUN THIS OFFENSE. I WOULD LIKE HIM TO BE ABLE TO….. BUT THE BEST MAN GETS THE JOB. HE SIMPLY HAS TO PERFORM. NO EXCUSES!!!!!!!!!

  23. Hunterboyz says:

    What is the GOP?

  24. red&goldforlife says:

that’s my point Alex hasn’t shown enough to even convince us that he could start over a guy that got drafted in the same class and virtually hasn’t played.

Look all of us hate this shit we are used to wining and seeing this kid learn the game in front of our eyes is frustrating! This is not college it is the pros and if you don’t win people get fired and teams get dismantled. Smith is still young but he has terribly underachieved. Yes, he had a decent year but he had a great running back and 16 games + the offense was designed specifically for his strengths. Martz offense is quick decisions, accuracy and most of all performing under pressure, Martz already said whoever can take the heat gets the job no catering or babying to a guys needs.

Nolan and Martz can’t wait another year they half to play the guy that gives us the best chance to win! I just don’t think Smith is ready for that yet he hasn’t shown that he is!

  25. West says:

9ers traded for Jason Taylor….gave up our 1st and 3rd

  26. Adam says:

OK.Medford ya im back.First let’s start of with Gas prices and Bush. Are you fckn kidding me.Last time I checked we get our gas,FROM SAUDI ARABIA AND KUWAIT.They make the prices u fuckstick not Bush.Second I can see your a commy liberal coward.I have kids also and just maybe ur kids and my kids may have to realize that ther’s people that wanna CHOP OUR HEADS OF YOU MORON.And our kids might just have to man up and fight for our country one day.Well from what I hear from your pussy ass it will be my kids.Bush killing innocent kids for no reason? It’s war jackass, thats what happens in war.I didnt hear anything from you about the 3,000 people that got slaughtered when they flew 2 planes into our buildings. You make me sick.Bush stands up to these cowards and assholes like yourslf criticize him for it.Well not me im behind him 1000%.And Derek Smith would be a niner still today if he woulda took a paycut.

  27. West says:

    Real funny….da got me……Jason Taylor is not a 9er……Fools Day…”GREAT”……a 1st round pick would b much for his age……

  28. Adam says:

OK.I believe we just screwed our whole season up in 1 fucking day.I can’t believe we just gave a 1st and 3rd round draft pick for Jason Taylor.Especially when we just get word that Frank Gore’s carrer is OVER.Im sorry boys but we are finished, done, its over.I’ve never been so disappointed as a 9er fan ever in my life.I can’t fucking beleeive this, this is outrageous. This is what we get fr letting Scott Mcloughlin be out GM.A fucking trade that ruins our season. No draft picks to pik up a starting running back. Were fucked!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

  29. West says:

Adam…….i think u forgot to say April Fools Day in there somewhere…….something positive…like How we feel about Lito Sheppard coming to da 9ers….Could happen…”right” it came out be for April Fools Day

  30. Adam says:

  35. West says:

  36. Forensics187 says:

This trade could be true, that cat can straight up play. It may, or may not be true, but don’t let 4-1 fool you.

  37. Adam says:

What about the Frank Gore Hip injury.Did any one here if that was a joke?

  38. Adam says:

I read the Gore thing on 49ersparadise.com

  39. Mike Hancho says:

I honestly dont give a flip who starts at QB this year.I just want to win.Be it Smith,Hill,or O’sullivan.Trust Martz on picking the right QB for the job.I cant believe some of you Niner fans are caught up in this whole controversy crap.

  40. Medford says:

Give me a break Mcsain. Bush is responsible for gas prices donkey asshole. U could all tell how dumb Adam is he belived all the april fools day garbage out there today stupid motherfucker

  41. Los Banos Jerry says:

Medford Adam is wrong GOP doesn’t stand for Grand old party. It
    stands for GAYS ON PROWL

  42. Medford says:

Thanks Los Banos Jerry atleast someone is on my side about this one. Example how bush is responsible for gas prices cause every country hates us and r $ is worth nothing and also that useless war in Iraq is making this country bankrupt. Also I dont see people getting there heads cut off in the U.S. . More troops need to be in Afghanastan thats where the trouble is.

Sorry Pundit about going all political on this site its just I hate when people talk out of there ass…. GO NINERS

  43. Mike says:

Houston WR Donnie Avery ran a 4.34 and a 4.35 forty time, recorded a 37 ½” vertical jump, a 3.91 (20 yard) short shuttle, a 10′6″ long jump, and a 6.30 3-cone drill at his pro day workout on Monday…Avery’s performance in the position drills was reportedly outstanding…18 NFL teams were present at the workout, including representatives from the Niners, Cowboys, Texans, Saints and Titans.

  44. West says:

Haralson was a fifth-round draft choice in 2006 who missed most of his rookie season when he went on injured reserve with a torn pectoral muscle. Haralson began the 2007 season slowly but started to come on strong at midseason and got plenty of playing time at outside linebacker. He started 11 games, finished with 42 tackles and had 2 ½ sacks.

Unless the 49ers tap an outside linebacker (Quentin Groves) early in the draft, some observers believe Haralson will wrestle away a starting job from Tully Banta-Cain. Haralson certainly showed improving pass-rush skills and he has a big supporter in GM Scot McCloughan. But don’t count Banta-Cain out just yet. I know I haven’t been an ardent TBC supporter, but I was watching NFL Network the other day and saw Banta-Cain in the AFC Championship game in which the Patriots lost to the Colts. I’ll be damned if TBC wasn’t in Peyton Manning’s grill throughout the second half of that game. I’m talking just about every single pass play! Banta-Cain was running over blockers, throwing them to the ground. He was unstoppable! Of course, the Colts chose to block TBC sometimes with a tight end, sometimes with a running back. And toward the end of the game, they had the left guard pop out and try to block him with minimal success. It just goes to show how important the surrounding cast is to a pass rusher’s success. TBC suffered as much as anyone when Manny Lawson tore a knee ligament last year. We (read: me) probably should reserve judgment until everyone is healthy.

  45. West says:

Since we lost Garcia…Owens….Peterson…..Funny that five years later the 49ers are still looking for 1.) a quarterback. 2.) a dominant wide receiver 3.) a three-down outside linebacker.

  46. Adam says:

Hey Medford I dont give a fuck if every country hates us.They can all kiss my ass.And the U.S.A. going bankrupt? You gotta be out of your godamn mind. And wait ur calling me a donkey asshole. What a fucking idiot. You dont know anything about polotics or fooball, you really are a fuckstick.I think your the most ignorant moron I have ever come across in my life.Pundit I am not sorr about going political on this sight.Especialy when jerkoffs like medford spew watery shit out of their mouths.Oh,and ya I they did get me real good with the April Fools joke. I was about to shit myself.I’m done with politics, especially with commy’s.Go McCain and Go 9ers

  47. West says:

    a f***stick….lol, thats classic

  48. Adam says:

frank gore carrer is ending, omg

  49. Adam says:

Just to let you know, there are 2 Adams on this site. The 1 above is not me.

  50. West says:
